Three Years After Dobbs — The State Abortion Map, Recompiled

Ballot initiatives passed reproductive-rights protections in 8 states. Elena V. maps the post-Dobbs terrain.

Three years after the Dobbs decision returned abortion regulation to the states, the political map is clearer.

The three tiers

  1. Constitutional protection (11 states) — California, Colorado, Michigan, Ohio, Missouri, Nevada, New York, Vermont, Kansas (via ballot), Maryland, Kentucky. Ballot initiatives in six of these states passed with majorities that included Republican voters.
  2. Legislative access (14 states) — Illinois, Minnesota, Washington, Oregon, Arizona, and others. Access is protected by statute but not by state constitution — one election away from reversal.
  3. Restrictive states (25) — Texas, Florida, Alabama, and others. Total or near-total bans in effect. Litigation over medical exemptions still active.

The turnout signal

In every one of the seven ballot initiatives that made reproductive rights a direct question to voters, the pro-access side won. In three cases (Kansas 2022, Ohio 2023, Michigan 2022) it won by double digits — including in counties Trump had carried by double digits the year before.

That is the signal the party has organised around for 2026 and 2028.
